This page describes the terms and conditions that govern your use of Kevmoâs Kitchen (kevmoskitchen.com) and any associated mobile applications (collectively, the âServicesâ), offered by FanPours, LLC (âwe,â âus,â or âourâ).
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICES, AS THEY AFFECT YOUR LEGAL RIGHTS. IMPORTANT NOTICE - ARBITRATION AGREEMENT AND CLASS ACTION WAIVER: BY AGREEING TO THESE TERMS, YOU AGREE THAT ALL DISPUTES BETWEEN US WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION. YOU ARE GIVING UP THE RIGHT TO GO TO COURT AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT.
1. GENERAL RULES
1.1 Agreement: By using the Services, you agree to abide by all of the terms and conditions of these Terms of Service between you and FanPours, LLC. 1.2 Changes: We may change, add, or remove portions of these Terms at any time. Such changes become effective immediately upon posting. It is your responsibility to review these Terms prior to each use. 1.3 Continued Use: Your continued use of the Services following the posting of updated Terms indicates your acceptance of the changes.
2. CONTENT AND INTELLECTUAL PROPERTY
2.1 Ownership: All materials published on the Servicesâincluding recipes, text, photographs, images, video clips, "look and feel," and metadata (the âContentâ)âare protected by copyright and owned or controlled by Kevon Ashton. 2.2 Personal Use: The Services and Content are intended for your personal, non-commercial use. You may download or copy Content for personal use only, provided you maintain all copyright notices. 2.3 AI & Machine Learning Restrictions: Non-commercial use does not include the use of Content for the development of any software program, model, algorithm, or generative AI tool. You are strictly prohibited from using the Content to train, fine-tune, or ground any machine learning or artificial intelligence system. 2.4 Prohibited Acts: You may not modify, publish, reproduce, create derivative works from, or in any way exploit the Content or Services without prior written consent from FanPours, LLC.
3. HEALTH, NUTRITION, AND ALLERGY DISCLOSURES
3.1 Informational Purpose Only: Kevmoâs Kitchen provides recipes and nutritional information for educational purposes only. We are not doctors or registered dietitians. Content should not be used as a substitute for professional medical advice. 3.2 Allergy Warning: User Responsibility: You are solely responsible for verifying all ingredients in our recipes against your own known allergies or sensitivities. Cross-Contamination: We cannot guarantee that any recipe is 100% free of specific allergens (e.g., nuts, gluten, dairy). Even if a recipe is labeled "Gluten-Free," you must ensure your specific brands and cooking environment are safe. Label Reading: Always read the labels of the specific products you purchase. Manufacturing processes change, and FanPours, LLC is not responsible for the contents of third-party ingredients. 3.3 Nutritional Data: Nutritional information provided is calculated using third-party databases and is an estimate only. Variations in brands, portion sizes, and preparation methods will alter actual nutritional values.
4. USER-GENERATED CONTENT (Submissions)
4.1 License: By posting comments, reviews, or photos (âSubmissionsâ), you grant FanPours, LLC a perpetual, non-exclusive, world-wide, royalty-free license to use, copy, edit, and distribute your Submissions in any media. 4.2 Conduct: You shall not upload any libelous, defamatory, obscene, or illegal material. You agree to be courteous and avoid "spamming" or personal attacks. 4.3 Responsibility: You are solely responsible for the content of your Submissions. FanPours, LLC reserves the right to delete or edit Submissions deemed unacceptable at our sole discretion.
5. DISCLAIMERS AND LIMITATION OF LIABILITY
5.1 "As Is" Basis: THE SERVICES AND CONTENT ARE DISTRIBUTED ON AN âAS ISâ BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. 5.2 Assumption of Risk: Cooking involves heat, sharp tools, and food handling. By using our recipes, you voluntarily assume all risks associated with food preparation and consumption. 5.3 Limitation of Liability: IN NO EVENT WILL FANPOURS, LLC, ITS OFFICERS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF REVENUE OR PERSONAL INJURY, ARISING OUT OF YOUR USE OF THE SERVICES.
6. REGISTRATION AND SECURITY
6.1 Accuracy: You must provide accurate registration information. Each registration is for a single user only; sharing login credentials is prohibited. 6.2 Age Requirement: You must be at least 13 years old to use the Services. If you are under 18, you must have the consent of a parent or legal guardian.
7. ARBITRATION AND GOVERNING LAW
7.1 Governing Law: These Terms are governed by the laws of the State of Missouri, without regard to conflict of law provisions. 7.2 Arbitration: Any controversy or claim arising out of these Terms shall be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
8. TERMINATION; SURVIVAL
8.1 You may terminate your Kevmoâs Kitchen account by clicking on the âMy Accountâ button on the main menu, followed by the âManage Subscription" on the My Account page. You will continue to have access to Kevmoâs Kitchen after terminating your subscription until the final day of your paid subscription period. Refunds will not be issued for annual subscriptions or monthly subscriptions mid subscription term. 8.2 FanPours may, in its sole discretion, terminate or suspend your access to all or part of the Services for any reason, including, without limitation, breach or assignment of these Terms of Service. 8.3 The provisions of these Terms of Service will survive the termination of your account or access to all or part of the Services.
